Tennessee Clinic Settles ADA Claim

Murfreesboro Medical Clinic [(MMC)] settled an Americans with Disabilities Act (ADA) nondiscrimination claim with a patient who said she was denied medical treatment, according to a press release from the United States Attorney’s Office for the Middle District of Tennessee.

MMC agreed to adopt a written ADA nondiscrimination policy and pay $2,500 in compensatory damages to resolve the allegations, the press release said. MMC also agreed to provide ADA compliance training to staff who may interact with people with disabilities.

“The matter was brought to our attention. As soon as it was, we investigated. We worked very cooperatively with the U.S. Attorney’s Office and came to what we believe was a very satisfactory result,” said Joey Peay, the clinic’s CEO.

The settlement resolves allegations made by a woman who is disabled and uses a wheelchair, according to the new[s] release. The woman said she was denied medical treatment at the office of Dr. Joseph Boone because of her inability to transfer from her wheelchair to an examination chair.

The woman alleged that MMC told her that she would need to bring someone with her to the appointment to help her transition to the examination chair, and then allegedly refused to make reasonable modifications to perform her examination, the press release said. She sought care at a different facility further away.

Peay said he was surprised to learn about the allegation because the clinic treats hundreds of patients every day, many of whom have mobility issues that they accommodate.

“We’re glad it’s been resolved [satisfactorily],” Peay said.
