Justice Department Files Statement of Interest in Title II Lawsuit Involving Child with Diabetes

The Justice Department announced that it has filed a Statement of Interest [PDF, 16 pages | Word] in private litigation pending in the United States District Court for the Eastern District of Kentucky, R.K. v. Board of Education of Scott County. In that case, plaintiffs have alleged an ADA violation based on the forcible transfer of a child with diabetes to an out-of-zone school because his zoned school lacked a full-time nurse. Among other things, the Departments Statement of Interest addresses the proper framework for evaluating the Title II ADA claim at issue in this case.
