Tennessee newspaper settles ADA suit for $150,000

The newspaper, a subsidiary of Gannett Co. Inc., agreed to pay Mr. Dubois $150,000 for violating the Americans with Disabilities Act, as well as provide ADA training to its employees and document for EEOC review its responses to future ADA accommodation requests. The EEOC lawsuit (Case No. 1:11-cv-01252), filed in U.S. District Court for the Western District of Tennessee, Eastern Division, charged that The Jackson Sun fired a commercial print manager exactly one week after his return from a medical leave of absence. He had sustained permanent spinal cord damage after back surgery. The EEOC said that The Jackson Sun could have accommodated the employee with minimal effort and that his termination was discriminatory.
