Justice Department Issues Guidance about Olmstead and the ADA Title II Integration Mandate and Employment

November 2, 2016

The Justice Departments celebration of National Disability Employment Awareness Month provides a chance to reflect on the progress achieved and the challenges that remain for people with disabilities around the country who can and want to work in the mainstream American economy. In 1999, in Olmstead v. L. C., the Supreme Court ruled that under the Americans with Disabilities Act (ADA), "unjustified institutional isolation of person with disabilities" constitutes discrimination, plain and simple.

Building on our enforcement work in recent years and to help other states comply with the ADA today the Justice Department issued new guidance about the ADAs Title II integration mandate and employment.

The guidance explains how the ADA integration mandate and Olmstead apply to public employment service systems for individuals with disabilities. The guidance also includes detailed answers to frequently asked questions about the application of the ADA and Olmstead to persons in or at serious risk of unnecessary segregation in sheltered workshops, and remedies to address violations of the integration mandate.
