Justice Department Announces ADA Title I Consent Decree with Bolivar County, Mississippi

The Justice Department, along with the United States Attorneys Office for the Northern District of Mississippi, announced today that it filed a complaint and proposed consent decree in the U.S. District Court for the Northern District of Mississippi against Bolivar County under Title I of the Americans with Disabilities Act (ADA). The complaint alleges that Bolivar County terminated a correctional officer with the Bolivar County Regional Correctional Facility one day after he disclosed during a post-hire physical examination that he was previously diabetic.

The consent decree (subject to approval by the court) requires Bolivar County to offer the complainant a correctional officer job with retroactive seniority, pay a total monetary award of nearly $100,000, and train correctional facility employees on ADA Title I requirements.
