Suspension for Alcohol Use Did Not Violate the ADA

“Caitlin” worked as a cashier in a Rockland County, New York, hospital. Over her 28-year career, Caitlin took multiple leaves of absence for alcohol abuse treatment. In May 2008, the county discovered that Caitlin was intoxicated at work and suspended her pending a satisfactory medical evaluation. The examining physician found a high risk of relapse and recommended that Caitlin not return immediately to work. He recommended 3 months of intensive alcohol treatment followed by a reevaluation to determine fitness for duty. Caitlin was eventually approved to return to a kitchen position subject to the 1-year alcohol ban.
